Take Yer Pick:

Major media outlets - along with Swimming World* - are picking up on the latest Title IX lawsuit.

Why?

Probably because it's over proportionality.

Not such a big deal, right? After all, we've see lawsuits over proportionality for years.

This one's a big deal because it involves high schools.

I honestly don't think they are stating their case very well and will lose if it is based the way it is written. One of the 3 parts to the test are that there must be enough opportunity based on interest. How many girls are not interested in sports because they have found a calling in theater or dance or cheerleading? I wonder how the proportionality test would fair if a different question was asked - not, is the ratio of students to athletes by gender equal BUT is the ration of students to those involved in extracurricular activities by gender equal? or if we don't look at extracurricular, then "what ever counts for a PE credit, even if it is not athletics (e.g. band, dance, cheerleading)??? Ask the wrong question, get the wrong answer.
